A beautiful condo can still be the wrong fit if the lease does not match your plans, the parking does not suit your cars, or taking the dog outside is harder than expected.
Before I recommend a South of Fifth residence, I want to understand how you will use it. Budget and bedroom count help us begin. Building rules, the specific apartment and your daily routine help us decide what belongs on the shortlist.
These are some of the details I want resolved before a client tours, applies or buys.

Quick answers before you shortlist a South of Fifth condo
Question | The useful answer |
|---|---|
Does a six-month minimum mean I can lease twice a year? | No. Minimum duration and leasing frequency are separate restrictions. Portofino Tower's documents specify six calendar months and no more than one lease commencing in the same calendar year. |
Can I assume I can break a lease for two months' rent? | No. Check the signed lease and any early-termination addendum. Building rules can also affect whether a replacement tenancy is feasible. |
Does “pet friendly” tell me where my dog can go? | No. Portofino Tower's dog walk is beside valet. ICON South Beach's reviewed FAQ requires dogs to leave the property to relieve themselves. Permission and daily access are separate questions. |
Does “one parking space” explain the whole arrangement? | No. Confirm assigned rights, self-parking, valet and the treatment of a second vehicle or guests. |
Does EV charging mean I can arrive and plug in? | Not necessarily. ICON South Beach's reviewed FAQ describes resident registration, an account and a convenience fee. Check access, availability and cost. |

Portofino Tower: minimum lease term and permitted frequency are different rules
At Portofino Tower in South of Fifth, the governing documents on file specify a six-month minimum. They also state that no more than one lease of a unit may commence in the same calendar year.
A six-month minimum therefore does not mean an owner can automatically enter into two six-month leases in that year.
For a buyer planning personal use around rental periods, that frequency limit can change the ownership plan. For a tenant, the proposed dates still need to fit the owner's offering and the apartment's lease history.
A building's minimum does not require every owner to offer that minimum. An owner may offer an annual lease even when the building permits a shorter term. A listing entry of “180 days” also should not replace the governing wording of six calendar months.
I want the proposed start and end dates reviewed under the current rule, including how renewals and any proposed exception are handled.

If you may need to leave early, make the exit plan part of the building search
This is a building-fit question many tenants miss.
If a Portofino residence has already used its permitted lease commencement for the current calendar year, a replacement tenancy starting that same year may not fit the building's rule. That can make an owner less willing to negotiate an early departure.
Timing matters. A lease that began last year is different from one that began this year. Continued occupancy alone does not establish that this year's permitted commencement has been used. A proposed replacement beginning next calendar year also presents a different question.
If there is a meaningful chance you will need to move before the term ends, I would make written exit protection a priority. Portofino may be a poor fit for that plan if it depends on finding an immediate replacement without an agreed way out.
A building permitting more frequent leasing may give an owner more flexibility to consider a replacement. It does not guarantee that the owner will agree, that another tenant will be found, or that unused leasing capacity remains.
Buildings to compare when replacement flexibility matters
These examples need to be checked against the actual apartment, current association rules and proposed dates:
Building | Minimum term in the reviewed guidance | Leasing frequency | What to verify |
|---|---|---|---|
Portofino Tower | Six calendar months | No more than one lease commencing in the same calendar year | Actual commencement history, renewal treatment and any specific written exception. |
ICON South Beach | Six months | Maximum two rentals per year in the association FAQ reviewed | How “year” is counted, remaining allowance, current amendments and tenant approval. |
Cosmopolitan | Confirm for the proposed dates | Confirm with the association | Request the current rental rule and counting method before relying on replacement flexibility. |
ICON and Cosmopolitan are therefore useful candidates for a flexibility comparison. Neither should be described as a building where a tenant can automatically break a lease.
Two months' rent is not an automatic exit. Florida Statutes §83.595(4) describes an agreed early-termination or liquidated-damages option accepted when the rental agreement is made, using a separate signed addendum and subject to statutory limits. The statute also describes alternative landlord remedies. Without an agreed exit, moving out may leave continuing rent obligations beyond two months; the actual exposure depends on the lease and applicable law. A building's leasing restriction does not itself erase an applicable agreed termination right. Review the lease, addendum and any proposed written release with your attorney. Accrued charges or damage claims may remain.
For a buyer, this is also a question about the unit's intended rental use and what happens if a tenant leaves early. For a tenant, it is about whether the exit plan is realistic before signing.

With a dog, walk the route—not just the amenity list
“Pet friendly” does not tell you whether the particular owner permits your ordinary pet, where it may go, or how several trips outside will feel.
At Portofino Tower, the dog walk is next to valet. That is a practical detail worth seeing during a showing.
ICON South Beach provides a useful comparison: its reviewed rules direct residents to take dogs off the property to relieve themselves. A building can permit dogs while requiring that trip outside.
Walk the route from the residence to the elevator, through the permitted exit and to the appropriate relief area. Look at the distance, exposed sections, steps and current street conditions. A dog area does not automatically mean a covered route, and a short walk does not establish that it stays dry during heavy rain.
For a rental, check the association's requirements and the owner's terms for that residence. Accommodation requests follow the appropriate separate process.

Parking: two bedrooms do not mean two self-parking spaces
Two listings can each say “one parking space” while offering different daily experiences.
ICON South Beach's reviewed FAQ describes one developer-assigned space for most units, with exceptions for certain combined residences and penthouses. It also describes limited valet capacity and warns that guests may be turned away.
At Portofino Tower, the documents distinguish assigned resident spaces from guest and valet arrangements. The residence's assigned rights matter; there is no safe building-wide assumption that every apartment receives the same number of self-parking spaces.
For each serious option, I want to establish:
- Which spaces are included with this residence.
- Whether each vehicle can self-park or must use valet.
- What happens with a second car or overnight visitors.
- Whether the actual vehicle fits the applicable restrictions and garage.
- Which registrations, charges and availability limits apply.
An application form with two vehicle fields does not itself grant two spaces.

EV charging: check the service you can actually use
“The building has chargers” is not a complete answer for an EV-dependent client.
ICON South Beach's reviewed FAQ describes charging for residents through an established account, with a convenience fee. The next questions are whether the incoming resident can register, which equipment works with the vehicle, how access is managed and what the current charges and availability are.
Communal charging, permission for a private installation and a future installation plan are different things. For a tenant, any required owner authorization and registration need to be resolved before relying on the service.
A charger in a photograph is not proof that an incoming resident can use it immediately.

The best gym is the one that works for your routine
A fitness-center photograph does not tell us whether the facility suits the way you train.
I would compare the equipment you use, space, current hours, crowding at your usual time, and access for residents, trainers and guests.
Portofino's reviewed Club rules distinguish day visitors from registered guests staying in a residence. They also address personal-trainer identification and access. A guest parking pass should not be assumed to grant gym or spa access.
Spa rules are separate, too. ICON South Beach's reviewed FAQ describes age and guest requirements for its spa. Those should not be generalized to every fitness facility or every age group.
An objective comparison is more useful than naming a “best gym” from an amenity list.

An elevator ride to dinner can matter more than another amenity
At ICON South Beach, the on-site restaurant can make dinner a short trip downstairs. Its reviewed FAQ also describes delivery to residences and private catering.
That may matter on an evening when getting everyone out of the building takes more effort than the meal itself. It can also help when working late, arriving after a trip or entertaining.
I would check current operation, hours, access and services before treating those arrangements as part of a client's plan. On-site dining, nearby restaurants and a resident meal service are different offerings.
08 · Your next decision
A lease start date is not an approved move-in date
ICON South Beach's reviewed FAQ requires approval before a move is scheduled. Delivery rules are addressed separately. Movers, insurance documents, elevator reservations and furniture deliveries need to align.
Storage also requires its own check. The same FAQ describes storage cages with an annual arrangement and a waiting list. Storage appearing on an amenity list does not establish that a cage is available with the apartment.
These details are part of a useful tenant shortlist, especially when the move is time-sensitive.

The apartment still needs its own comparison
Building knowledge does not replace reviewing the actual line, floor, room outlook, layout, balcony, condition and parking.
A water photograph from a common-area gym or an aerial view is not proof of the view from the living room.
When reviewing the Portofino Tower #405 rental listing, I would use the residence-specific photographs and offered terms, then resolve the questions that matter to the person considering it. The building name alone does not answer them.

What representation adds
In a 2022 ICON South Beach purchase, I helped a buyer test alternatives farther north through Miami Beach and North Bay Village before returning to South of Fifth.
The eventual purchase was an original-condition residence. The comparison included renovated and original-condition sales, the buyer's tolerance for work and the intended use. I represented the buyer in the purchase and helped assemble a renovation team.
At Meridian Place, I represented the sellers of Residences 1 and 2 at 325 Meridian Avenue and later represented the buyer of Residence 15 in a separate transaction. All three were reported at 1,300 square feet, but their configurations, condition, renovation and parking context differed.
That is the work behind a recommendation: test the assumptions, compare meaningful differences and identify what still needs an answer.
For buyers, that includes the ownership and leasing plan, current association documents, carrying costs and appropriate inspections. For tenants, it includes offered terms, owner and building requirements, the application path and preparation for possession. The scope should be clear in the representation agreement.
Questions before you commit
Questions buyers and tenants ask
Can I rent at Portofino Tower for six months?
The governing documents on file specify a six-month minimum, but that does not establish that every residence is offered for six months. Check the owner's terms, proposed dates, lease commencement history and current approval requirements.
Is a building that allows more leases per year easier to leave early?
It may offer more replacement flexibility, subject to the remaining permitted starts, minimum term, owner agreement and approval process. It does not create an early-termination right or release the existing tenant.
Does a pet-friendly building work for every dog?
Check the exact animal, association requirements, owner's terms and actual relief route. A broad pet description cannot answer all four.
Can my visitors use the gym or spa?
Check the actual guest rules. Portofino's reviewed Club rules distinguish day visitors from registered guests staying in the residence. Verify the facility and access sought.
Can I rely on a promised EV installation?
Separate a plan from an operating service. Confirm completion, resident eligibility, registration, compatibility, access and current costs before relying on charging for the move.
What should I send Adrian to begin?
Send the property links, intended dates or ownership plans, budget and the two or three requirements most likely to change the shortlist. Examples include an agreed exit option, two self-parking spaces, a practical dog route or usable EV charging.
